Introduction

This privacy policy (“Privacy Policy”) applies to personal data that we collect from you as a customer (“you” or “your”). The Data We Collect and Store

Depending upon how you use my website, or work with me I may collect some or all of the following personal data:

▪︎ The ages of any children participating in the photoshoot

▪︎ The date of birth of any newborn babies participating in the photoshoot

▪︎ Contact information including your address, e-mail address, and telephone number

▪︎ Details about your business (for commercial photo shoots) including your business name and job title or profession

▪︎ Information you have given me about your preferences and how you would like to be photographed

▪︎ Your name and e-mail address if you sign up to receive my e-mail newsletter

▪︎ Photographs from your photo shoot with me

I do not collect or store any of your payment details, or any sensitive data.

How and why I use this data:

We use your personal information in the following ways:

▪︎ To provide you with our services and to create and deliver the products you have requested and contact you regarding your use of the services. Such use is necessary to respond to or implement your request and for the performance of the contract between you and us.

▪︎ As necessary for certain legitimate business interests, which include the following:

where we are asked to deal with any enquiries or complaints you make;

▪︎ If you ask us to delete your data or to be removed from our marketing lists and we are required to fulfill your request, to keep basic data to identify you and prevent further unwanted processing, and to (a) comply with legal obligations, (b) respond to requests from competent authorities; (b) protect our operations; (c) protect our rights, safety or property, and/or that of our affiliated businesses, you or others; and (d) enforce or defend legal rights, or prevent damage.

▪︎ With your consent, we may use your photographs to promote and advertise our business, including (a) in our studio and in our printed publications, presentations, promotional materials (including leaflets, brochures, stickers, bookmarks, posters, fact sheets, calendars); (b) on our website and other digital advertising of our services; and (c) in social media forums such as Instagram, Pinterest and Facebook.

Cookies

We use cookies on our website. These are small files that your browser automatically creates and saves on your end device (laptop, tablet, smartphone, or such when you visit our website. Cookies do not cause any harm to your computer and do not contain any viruses, trojans, or other malware.

Storage of Personal Data

David Lowerson Photography Ltd is based in the UK and we store data in the United Kingdom.

We store data in the following ways:

▪︎ Digital photographs on hard drives stored in our home office and accessed only by us.

▪︎ We store digital photographs with an online gallery provider based in the USA.

▪︎ Studio management software for storing your contact information, sending and storing e-mails contracts, invoices, and questionnaires, storing our notes about your preferences and how you would like to be photographed, and for managing your shoot. r and browsers remain private and integral.

▪︎ We use email marketing software with servers that are located in the United States. The software provider is certified as compliant with the EU-US Privacy Shield framework.

Sharing of Your Personal Data

We take your privacy very seriously. We do not sell your data to third-party organisations.

These include:

▪︎ Delivery and Postage Service Providers to allow us to send you documentation and orders you have placed. (Information shared includes Name, Address)

▪︎ Manufacturers (our printing labs) if we are sending an order directly to you from a lab. (Information shared includes Name, Address, and in some cases e-mail address / mobile number)

Payment information

Any credit/debit card payments and other payments you make will be processed by our third party payment providers and the payment data you submit will be securely stored and encrypted by our payment service providers using up to date industry standards. Please note that we do not ourselves directly process or store the debit/credit card data that you submit.

We store and use this card or payment information for the purpose of processing any future payments that you make for additional goods and services. We will store this data in accordance with our legal obligations under applicable law and only for so long as legally permitted.

You may choose to opt out of us holding your card or payment data although this means that you will need to re-supply us with card/payment details for the purpose of making any future purchases.

This Data Protection Policy is the latest version and was last amended as of October 2023.
